The contingency fee has been around for a long time. It was created due to the fact that many people following an accident cannot pay their bills let alone pay an attorney an hourly rate. Firms such as ours that take cases on a contingency fee basis typically front the costs of pursuing a case and thus assume the risk of losing those costs in the event the case is lost. We have seen firms that bind their clients to a contingency fee as high as 45%. Most firms take 40%. We have no idea what exactly a fair contingency fee is. We simply believe that the client should receive at least twice as much as we do so we never take more than 33 1/3% in an auto accident case.
